My state has a comparative negligence law. How does that work and who decides how much I was at-fault?

Here in Florida we have what's called comparative negligence. Comparative negligence, is a fancy word to determine the percentage of fault. Simply meaning what percentage were you at fault verses what percentage the other party was at fault. You still have all your legal rights to bring a claim and let the facts and circumstances and the attorney determine what percentage the at fault party bears, and what percentage falls on you.
