After the lawsuit is filed, your lawyer can always negotiate your claim at any time. In Florida we have what's called a mediation conference which is a mandatory conference which may force a settlement. If at that time a settlement is not reached, you still have the option to go to court. But remember, hiring a lawyer that will go to court for you is important.
